 Terms and Conditions

The following terms apply to all services and products sold and delivered through Optifo ApS and other websites managed by Optifo ApS. These terms and conditions apply to any task undertaken by Optifo ApS.

Your access to and use of the website constitutes your agreement to be bound by these terms, establishing a contractual relationship between you and Optifo ApS. If you do not agree to the terms, you must not access or use the website.

Optifo ApS may occasionally modify the terms. Changes to the terms will take effect once Optifo ApS posts the updated terms in the appropriate location. Your continued access to or use of the website or purchase of our products after such postings constitutes your agreement to be bound by the modified terms.

   Optifo ApS is a provider and supplier of a software system for automating image processing. Optifo ApS offers a subscription solution with an accompanying app for processing car dealers’ and mechanics’ images.

2. **Prices and Payment**

   The applicable price is the one listed on the relevant product on Optifo ApS’s website or app on the day of the order. All prices are exclusive of VAT and are stated in EUR and DKK. However, customers can choose to pay in their own currency at the time of purchase.

   Optifo ApS may change the stated prices without prior notice. If a printing error occurs and the buyer should know or knows that it is a printing error, the buyer cannot claim the erroneous price. Optifo ApS may cancel any order resulting from a pricing error.

   When ordering, you will see the final price, which includes VAT and fees.

   Payments can be made with MasterCard and Visa cards. Optifo ApS will charge the amount only when the order is dispatched.

3. **Confidentiality**

   At Optifo ApS, we believe that trust and confidentiality are crucial for a good collaboration. All information received from or about you will be treated confidentially, and all employees are bound by confidentiality agreements.

4. **Liability**

   Optifo ApS is not responsible for outages or temporary interruptions on our website, power supply failures or internet connection issues, system vandalism (both physical and computer viruses and hacking), misuse of personal information, or other circumstances beyond Optifo ApS’s control. It cannot be guaranteed that you can use downloaded files on all computers, and by using the files, it is assumed that you have software capable of opening/reading the relevant file.

5. **Product Liability**

   For damages covered by Law No. 481 of June 7, 1989, on product liability, the law’s provisions apply.

   For product liability not covered by the law, the following limitations apply:

   – Optifo ApS is only responsible for personal injury if it is proven that the injury is due to an error or negligence committed by Optifo ApS or others for whom Optifo ApS is responsible.

   – Optifo ApS is responsible for damage to real estate and personal property on the same terms as for personal injury.

   Optifo ApS and the customer are mutually obligated to be sued in the court or arbitration tribunal handling compensation claims against either of them based on damage allegedly caused by the material.

6. **Delivery**

   The customer is given access to our software system as soon as payment is made.

   If access to the software system is delayed, Optifo ApS will notify the customer by email.

7. **Errors and Deficiencies**

   If the customer experiences errors or deficiencies with the service, the customer must contact Optifo ApS at info@optifo.com and document the error, after which Optifo ApS will determine whether there is an error or deficiency. For minor errors, the customer may be awarded image credits to their account corresponding to the number of images affected by the error.

   For major errors and deficiencies, the customer may receive a refund for the period the service was unavailable to them.

8. **Termination**

   The customer can cancel their subscription with Optifo ApS at any time. If the customer wishes to end the collaboration with Optifo ApS, they can either contact us at info@optifo.com or cancel through optifo.com. There is a termination period of 30 days plus the current month.

   No right of withdrawal is provided to the customer.

   The customer’s access to the service ceases after the termination of the collaboration.

9. **Complaints**

   You can file a complaint about a product by contacting us at info@optifo.com.

   You must complain within a “reasonable time” after discovering errors or deficiencies with the service.

10. **Privacy Policy**

    To enter into an agreement with us and shop on optifo.com, we need the following information about you: Name, Email, Address, CVR information, and payment information.

    Processing is carried out according to the rules in our Privacy Policy.

11. **Governing Law and Jurisdiction**

    Any dispute arising from your purchase through Optifo ApS and on the website, including the extent or validity of these terms and conditions, is subject to Danish law and must be brought before the Court in Kolding.
